Samarth India Foundation Issues Nationwide POSH Compliance Alert

Delhi – January 22, 2026 – In a landmark audit exposing systemic failure in workplace safety, Samarth India Foundation reveals that over 99% of Government of India Ministries, Departments, PSUs and Autonomous Bodies have failed to comply with binding Supreme Court directives mandating publication of Internal Complaints Committee (ICC) details on official websites.

The Hon’ble Supreme Court in Aureliano Fernandes v. State of Goa (Civil Appeal No. 2482/2014, May 12, 2023) issued unequivocal directions under Article 142 requiring that ICC details including email IDs, contact numbers and complaint procedures are made readily available on the website of every government authority and organisation.

Samarth India’s comprehensive audit of over 100 official government websites found zero compliance – a shocking dereliction exposing women employees across ministries to continued vulnerability. POSH Act Section 19(b) mandates conspicuous display of ICC details, yet government websites lack contact information for sexual harassment complaints, SHe-Box portal links for online reporting, published policies and annual compliance reports despite clear statutory obligation.

The Foundation has audited 100+ government websites, dispatched formal letters to all 93 Secretaries to Government of India, filed CPGRAMS grievances with PMO and initiated District Officer complaints while offering free compliance support to ministries.
