The Hon’ble Supreme Court in Aureliano Fernandes v. State of Goa (Civil Appeal No. 2482/2014, May 12, 2023) issued unequivocal directions under Article 142 requiring that ICC details including email IDs, contact numbers and complaint procedures are made readily available on the website of every government authority and organisation.

Samarth India’s comprehensive audit of over 100 official government websites found zero compliance – a shocking dereliction exposing women employees across ministries to continued vulnerability. Our mission to end hunger, ‘One meal at a time’, is a reality now

Mission Tripti came into existence with the acknowledgement that when the fundamental need for food and sustenance is not met, people are left vulnerable and powerless. It is our duty, as Samarth Indians, to empower these people with the knowledge that someone is looking out for them. They are not alone and helpless. Just knowing this can motivate people to take a step towards real empowerment. A person sitting in a skilling class with an empty stomach, knowing that their family is starving, cannot learn and grow. True empowerment starts with these basics.

Our experience of the first field trip under Mission Tripti on 10th March 2024 proved to us that hunger exists right under our privileged noses, around the corner from our comfortable and luxurious houses.

The first site of food distribution was a slum cluster in Sector 3, Gurgaon where we were able to feed nutritious, full meals from toddlers to old people. In the beginning, they were so anxious that the food will get finished before their turn that they refused to line up but after talking to them, showing them our supplies and assuring them that each one of them will receive food, they stood in line with bright, hopeful smiles.

After this, we visited a slum site and a dump site in sector 112, Gurgaon where families of ragpickers live in horrid conditions. There were young children here living in abysmal conditions with happy spirits who were grateful to receive the food and had even finished their meals before we left the site. The signs of malnourishment, negligence and mistreatment on these children’s bodies were a great motivation for Samarth India Foundation to continue the initiative of Mission Tripti while making more efforts to support these communities.

One of our objectives for this mission was to provide these meals with dignity which was a success as all the people present were able to peacefully and joyfully share this time, giving and receiving the meal with respect and kindness.

Safe Workplace is a Woman’s right

Preamble to the Constitution states that “Equality of status and opportunity” must be secured for all of India’s people and Article 14 of the Constitution ensures that everyone is treated equally under the law.

Consequently, a woman has a legal right to a secure workplace. In fact, Articles 14, 15, and 21 of the Indian Constitution contain the constitutional notion of equality and personal freedom. These articles defend a person’s right to life and personal liberty as well as their right to equal protection under the law and to a life free from all forms of discrimination.

The UN Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), which was enacted by the UN General Assembly in 1979 and is recognised by India, serves as additional proof of this. In terms of human rights and fundamental liberties in the political, economic, social, cultural, and civil arenas, it advocates equality between men and women. It’s often described as a global charter of rights for women. It underlines how discrimination and attacks on women’s dignity contradict the equality of rights principle.

A flagrant violation of women’s rights to equality and dignity is sexual harassment. Not only does it violate a woman’s fundamental rights under Article 19 (1) (g) of the Indian Constitution to “practise any profession or to carry out any occupation, trade, or business,” it also undermines equality and endangers the workers’ dignity and physical and mental health. This has a negative effect on life and means of subsistence and results in low production.

Roots of Sexual Harassment

Today, workplace sexual harassment is more widely recognised as a form of violence against women and a violation of women’s rights all across the world. In fact, violence against women in both the public and private spheres continues to be justified by the societal construct of male privileges in society. Sexual harassment essentially serves as a mirror reflecting male authority over women and its roots can be found in patriarchy, which is characterised by the belief that men are superior to women and that some types of violence against women are acceptable.

One of these is sexual harassment at work, which considers various types of such harassment to be unimportant and harmless. It is frequently justified as “natural” male activity or “harmless flirtation” that appeals to women. Contrary to popular belief, it has a major negative impact and is a prominent example of workplace sex discrimination. To make matters worse, ingrained sociocultural behavioural patterns that build a hierarchy of genders often place blame on the victim, escalating inequalities in the workplace and in society at large.

Why Sexual Harassment goes unreported?

Despite the fact that workplace sexual harassment has reached alarming proportions, most of the time women do not report the incident to the appropriate authorities out of fear of retaliation from the harasser, losing their job, being stigmatised, or losing their professional position and reputation. Women are compelled to adopt traditional gender roles in a culture where violence against women, both overt and covert, is a result of patriarchal norms. The greatest barrier in resolving and preventing sexual harassment is posed by these patriarchal ideals and attitudes held by both men and women.

Another reason is lack of awareness amongst the working women who may frequently experience sexual harassment, but they may not be aware that it violates their rights or that they have recourse. They need to be aware that they have options. Then there are those who would think that it is a private matter best handled between the parties.

Present context

Given the challenges in recording the experiences of persons who have been a victim of workplace sexual harassment, the entire scope of the issue is unknown. However, the studies that are currently accessible on the subject indicate that it is undoubtedly a problem in India today. Because it addresses this issue to protect the rights of women workers across the nation, the legislation represents a significant advancement for women’s rights in general.

Even though the official statistics on women’s employment in India are low, a large portion of the labour that women conduct is not included in these statistics. Where this is taken into account, it is argued1 that women’s overall labour force participation would be 86.2%. Estimates indicate that there is a sizable workforce of women; therefore, it is necessary to ensure their employment and rights, even though official data indicates that women’s labour participation rate is approximately 25.3% in rural regions and 14.7% in urban areas. 93% of women employees are working in the unorganised sector, where they are still not covered by any regulations. Since there are no regulations or safeguards in place to protect them, safety measures must be taken proactively.

Posh Act in India

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, was enacted in order to protect women’s right to equality in position and opportunity at work and to create safe working conditions for them. Women will be more likely to participate in the workforce if they feel safe doing so, which will lead to their economic empowerment and inclusive growth. The realisation of their rights to gender equality, life and liberty, and parity in all workplace conditions will be aided by the efficient implementation of the Act.

Through this Act, it is crucial to make sure that prevention is prioritised over harsh punishment. This necessitates extensive understanding of the Act among managers, employers, and workers themselves. It is crucial to take action to alter mindsets and attitudes through raising awareness of sexual harassment as well as the remedies available in order to change the current state of affairs.

Today, all workplaces in India are mandated by law to provide a safe and secure working environment free from sexual harassment for all women.

Safe working spaces for women is a win-win situation for all

Vishaka Guidelines as laid down by the Supreme Court of India

Vishaka and other women’s organisations brought a Public Interest Litigation (PIL) before the Supreme Court of India based on the facts of Bhanwari Devi’s case against the State of Rajasthan and the Union of India. It was urged that sexual harassment be acknowledged as a violation of women’s fundamental right to equality and that all workplaces, establishments, and organisations be held accountable and liable for respecting these rights.

The Supreme Court of India established legally binding guidelines in the landmark ruling Vishaka vs. State of Rajasthan (1997), basing it on the right to equality and dignity guaranteed by the Indian Constitution as well as the UN Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW).

It contained:

• A definition of sexual harassment
• Shifting accountability from individuals to institutions
• Prioritizing prevention
• Provision of an innovative redress mechanism

Sexual harassment, according to the Supreme Court, is any unwanted, sexually motivated physical, verbal, or nonverbal behaviour. Examples include making sexually suggestive comments about women, requesting sexual favours, and using sexually explicit images at work. The definition also addressed scenarios in which a woman can experience disadvantage at work as a result of risks related to hiring decisions that might have a detrimental impact on her working life.

Employers were required to make sure that there was no hostile work environment for women, and it was against the law to intimidate or victimise anyone who helped with an investigation, including the complainant who was being investigated and any witnesses.

It called for the formation of a complaints committee as a means of redress, which will investigate cases of workplace sexual harassment of women. To reduce excessive pressure on the complainant, the Complaints Committees were required to be led by a woman employee, have at least half of their members be women, and to include a third party person or NGO expert on the subject. The regulations applied to all paid and unpaid jobs in the public and private sectors.

Vishaka ruling established that foreign standards and legislation could be used to broaden the protections provided by India’s constitution and fill up any gaps that may arise. The Vishaka Guidelines and related legislation, which marked the beginning of India’s creative history in addressing workplace sexual harassment, have given the problem crucial prominence. Workplaces must now accept responsibility for this situation and make sure that women may work in environments that are secure and safe.

THE PoSH ACT

The Supreme Court, by raising the standard of responsibility and accountability in the Vishaka Guidelines, has obligated businesses, organisations, and individuals in authoritative positions to protect the fundamental right of working women to equality and dignity in the workplace. In order to reach that benchmark, institutions were required to fulfil the following three obligations:

• Prohibition
• Prevention
• Redressal

The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act was enacted in India in 2013. The Act’s stated goal is to protect women from sexual harassment in the workplace by requiring employers to provide a harassment-free environment, train employees, and implement policies that are consistent with the Vishaka judgement.

It’s worth noting that the Act is in addition to pre-existing legislation and provides women with a civil recourse. Therefore, any woman who experiences sexual harassment on the job can pursue legal action, both civil and criminal.

Global Standards and Norms

The worldwide society has, over time, established standards to serve as a guide for the development of legislation regarding sexual harassment in the workplace. The most important indicators are as follows:

1. Admitting that sexual harassment in the workplace is a form of discrimination and a violation of human rights.
2. Understanding that sexual harassment is discrimination based on a person’s gender.
3. The importance of each person’s inherent worth, dignity, and equality should be emphasised.
4. When women are victims of gender-based violence, such as sexual harassment, it limits their ability to exercise a number of essential human rights and freedoms. Some examples of these rights are:

• the right to life, freedom, and security of the person
• the right to equal protection under the law
• the right to the best possible standard of physical and mental health
• the right to reasonable and favourable terms of labour

5. The right not to be subjected to sexual harassment at work is an important part of ending violence against women and promoting women’s equality.
6. Sexual harassment should be included in the definition of violence in any legislation addressing violence against women. Sexual harassment is a form of discrimination and a violation of women’s rights that can have serious health and safety effects, and it should be explicitly recognised as such in any such legislation.
7. The International Labour Organisation (ILO) has also called attention to the fact that domestic workers have the right to “enjoy effective protection against all forms of abuse, harassment, and violence.”

In actuality, it is crucial for international law and policy frameworks to promote an understanding of sexual harassment as a fundamental human right and equality issue, rather than only a matter to be solved by labor/ employment legislation.
Putting these ideas into action calls for vigilant observation and a willingness to adjust to new conditions. The following are the first six basic steps that every company should remember and implement:

1. First, ensure that all employees, paid or unpaid, have been “effectively” communicated with regarding company rules.
2. Provide information on both informal and official channels via which employees can address or lodge complaints about sexual harassment in the workplace.
3. The third step is for each business, organisation, or institution to provide its employees with training on how to prevent and respond to sexual harassment in the workplace.
4. A well-trained Complaints Committee is essential to establishing credibility.
5. Those in positions of authority in an organisation should be encouraged to set a good example in the workplace.
6. The creation of a culture that does not tolerate sexual harassment in the workplace should involve both men and women.

The India Story

In India, sexual harassment in the workplace is now a criminal offence that cannot be ignored on moral grounds alone. The Vishaka Guidelines increased the threshold when they identified “each incident of sexual harassment” as a denial of the right to equality for the first time. The Act, which supports women’s constitutionally protected right to be free from sexual harassment in the workplace, incorporates this idea. It is now the responsibility of complaints committees in all workplaces to protect this right by instituting a transparent, well-informed, and accessible system for resolving complaints.

India’s novel approach to addressing the issue of sexual harassment in the workplace is to focus on prevention and set up a redress system that is at least half female and has a female chair and an external third-party expert. If the law and practice are modified sufficiently to satisfy international standards, that model has the potential to become a model for other countries to emulate. Today’s Indian workplaces must step up to the challenge of fostering gender parity if the country is to realise this vision.

Quid Pro Quo (literally ‘this for that’) includes Implied or explicit promise of preferential treatment in employment; or Implied or explicit threat of detrimental treatment in her employment; or Implied or express threat about her present or future employment status. Second form is Hostile Work Environment which includes Creating a hostile, intimidating or an offensive work environment and/ or Humiliating treatment likely to affect health or safety of the victim.

In short, we can understand that Workplace Sexual Harassment is a behaviour that is UNWELCOME and SEXUAL in nature. It often occurs in Matrix of Power and is a SUBJECTIVE experience where IMPACT not intent is what matters.

Gather Evidence

It is crucial to have evidence of the Sexual Harassment you have faced. This can include emails, messages, and any other communication that documents the behavior. If there were witnesses to the harassment or CCTV footage of the incident, these can also be included as evidence.

Who can complain?

Complaint against an act of sexual harassment can be filed by the aggrieved woman herself.

In case of physical incapacity of the aggrieved woman, the complaint can be filed with the written consent of the complainant by the complainant’s relative or friend, Co worker, Officer of NCW or SCW or any person who has knowledge of the incident.

In the case of mental incapacity of the aggrieved woman, the complaint can be filed by the complainant’s relative or friend, Special educator, Qualified psychiatrist/psychologist, Guardian/authority under whose care the complainant is receiving treatment/care or any person with knowledge of the incident, jointly with any person mentioned above.

In case of Complainant’s death any person with knowledge of the incident can file the complaint with the written consent of her legal heir.

In case Complainant is unable to file the complaint for any other reason, the complaint can be filed by any person who has knowledge of the incident with written consent of the aggrieved woman.

Where can the complained be filed ?

The Act provides for two kinds of complaints mechanisms: Internal Complaints Committee (ICC) and Local Complaints Committee (LCC). All Complaints Committees must have 50 per cent representation of women. ICC or LCC members will hold their position not exceeding three years from the date of their nomination or appointment.

What should the complaint contain?

The written complaint should contain a description of each incident(s). It should include relevant dates, timings and locations; name of the respondent(s); and the working relationship between the parties. A person designated to manage the workplace sexual harassment complaint is required to provide assistance in writing of the complaint if the complainant seeks it for any reason.

Implications of Section 9 of The Act for Employees

The Act specifies the punishment for the offense of sexual harassment. According to this section, any person who is found guilty of sexual harassment shall be punished with imprisonment for a term that can extend up to three years. The offender may also be liable to pay a fine.

The punishment for the offense of sexual harassment is severe, and it reflects the seriousness with which the government views this issue. It is essential to note that the punishment is not limited to the workplace. Sexual harassment can occur anywhere, and the offender can be punished under Section 9, irrespective of the location of the offense.

Implications of Section 9 of The Act for Employers

Employers have a responsibility to provide a safe and harassment-free workplace for their employees. The Act places an additional burden on employers to prevent sexual harassment at the workplace. Employers need to take measures to ensure that sexual harassment does not occur at the workplace, and if it does, they need to take action to address the issue.

Employers can take several measures to prevent sexual harassment at the workplace. They can conduct awareness programs for their employees, implement a code of conduct, and set up a mechanism for redressal of complaints. Employers should also take action against the offenders and ensure that they are punished for their actions.

If an employer is found to be negligent in preventing sexual harassment at the workplace, they can be held liable under Section 9 of The Act. Employers need to take this issue seriously and take measures to prevent sexual harassment at the workplace.

Prevention of Sexual Harassment at the Workplace

Prevention is better than cure, and this is true in the case of sexual harassment as well. Employers and employees need to take measures to prevent sexual harassment at the workplace. As per Section 19 of the Act, every employer shall:
