SAMARTH INDIA FOUNDATION

99% Government Ministries Non-Compliant with Supreme Court’s Directive on Women Safety.

Delhi – January 22, 2026 – In a landmark audit exposing systemic failure in workplace safety, Samarth India Foundation reveals that over 99% of Government of India Ministries, Departments, PSUs and Autonomous Bodies have failed to comply with binding Supreme Court directives mandating publication of Internal Complaints Committee (ICC) details on official websites.

The Hon’ble Supreme Court in Aureliano Fernandes v. State of Goa (Civil Appeal No. 2482/2014, May 12, 2023) issued unequivocal directions under Article 142 requiring that ICC details including email IDs, contact numbers and complaint procedures are made readily available on the website of every government authority and organisation.

Samarth India’s comprehensive audit of over 100 official government websites found zero compliance – a shocking dereliction exposing women employees across ministries to continued vulnerability. POSH Act Section 19(b) mandates conspicuous display of ICC details, yet government websites lack contact information for sexual harassment complaints, SHe-Box portal links for online reporting, published policies and annual compliance reports despite clear statutory obligation.

Samarth India Foundation, India’s leading POSH compliance authority, has launched Operation POSH Shield – a nationwide campaign to enforce Supreme Court compliance. The Foundation has audited 100+ government websites, dispatched formal letters to all 93 Secretaries to Government of India, filed CPGRAMS grievances with PMO and initiated District Officer complaints while offering free compliance support to ministries.

Government of India certified trainers from Samarth India have successfully delivered POSH sensitisation workshops for officers, staff and contract employees alongside advanced Internal Committee training featuring real case studies and video simulations. The Foundation has conducted compliance audits ensuring 100% statutory adherence and trained over 2000 government officers across ministries.

Samarth India respectfully requests circulars from all ministries within 30 days, prominent publication of ICC details on every government website, SHe-Box registration across departments and submission of annual POSH reports to District Officers. Continued non-compliance carries legal consequences including Supreme Court contempt under Article 142, POSH Act Section 26 penalties of ₹50,000 per violation, personal accountability of department heads and District Officer enforcement powers.

Samarth India Foundation Chairperson Suman Sanjay Aggarwal stated: “Even after the Supreme Court’s clarion call, women employees remain unprotected. It is the government’s fundamental duty to lead by example in women’s safety. If Ministries fail to implement even the simplest requirement of publishing ICC details on websites, how can we expect private entities to follow suit? The POSH Act is increasingly viewed merely as a compliance formality rather than a commitment to workplace dignity. Most government ministries and departments have also neglected mandatory awareness workshops and IC trainings. Publishing ICC details remains the most basic step – yet this too remains undone, reflecting a shocking lackadaisical attitude towards women’s safety at the highest levels of governance.”

Samarth India Foundation remains steadfastly committed to its mission of creating safe workplaces for every Indian woman. Through relentless advocacy, comprehensive training programmes, and unwavering enforcement of legal mandates, the Foundation will continue working towards the day when women’s dignity is non-negotiable across every government establishment in India.
